It is an utter joke and in my opinion totally politically motivated.

We know SPAM services are doing good work, but you can't block everything..
Sometimes it takes time for a spam facility to learn that something is
actually spam.

What's going to happen if some spam gets past the service? Will users be
able to log complaints with the ACMA and then the ISP gets fined?  That is
crazy talk.

What happens if everyone gets scared of this code and turns up the
sensitivity of their spam facilities and then legitimate email starts to be
regularly blocked... Then people will start to complain that we're
intercepting real email... Just because the guy talked about Viagra in an
email to his wife... Seriously... There is no way that this can work.

As part of the code the ACMA would need to specify a level of service and
clearly define 'best effort'.

I would also like to understand what their definition of Mail Provider is...
As in, is every company required to implement this? Is anyone who hosts
email for more than one domain?

Is it bound the company or the location of the mail service?  Can we move
our mail servers to colo's in the US?  Does it mean Google and Hotmail are
bound by it?  My Gmail account gets about 50 spam a day in which 5-10 get
through the Gmail spam facility... Does this mean they are liable for up to
$10mill?

The government could easily set up a company, throw a couple of million at
it, and provide a free spam product to all Australians and maintain a
blacklist of bad/naughty stuff.... And people who wanted to use it, can and
those that don't want to, don't have to... Why wouldn't they just do this?
Or award the contract to some other company.
